I have some questions about the Second Amendment.
1. At the time of the writing of the Constitution, what was
a militia and what was expected of gun owners in that regard?
2. Why is the “militia clause” of the Second Amendment so
often ignored in discussion and court judgments related to the Second
Amendment?
3. What interpretation would “militia” have in contemporary
American society?
4. What responsibilities do current gun owners have with
regard to a militia?
5. Who calls up and leads such a contemporary militia and
keeps it from becoming just a bunch of vigilantes?
6. Under what circumstances would it be necessary and legal
to form a militia of current gun owners?
7. If some current militias form—as they have—are they legal
under the Second Amendment?
